OFFICIAL RULES OF “WIN THE GOLD” RAFFLE

By participating in the “Win the Gold” raffle, entrants agree to the official rules and the decisions of Special Olympics Chicago/Special Children’s Charities, which will be binding and final to all matters related to this raffle.  All rules will be posted on the www.sochicago.org website and should be read by all participants prior to participation.

This raffle is being conducted with a license by the City of Chicago and pursuant to Illinois law and is void outside the boundaries of the state of Illinois.

 

RAFFLE PERIOD

Beginning October 1, 2020, Special Olympics Chicago-Special Children’s will begin posting the raffle on Facebook but is not affiliated with Facebook in any capacity whatsoever.  The raffle period may extend for one year from the issuance date of the raffle license.  Participants will be invited to join the raffle. During the raffle, participants may be able to request a position for the raffle of a particular item and purchase such request through Paypal or Zelle (preferred), paid directly to SCC.  This raffle is ONLY OPEN TO RESIDENTS OF ILLINOIS WHO ARE PHYSICALLY PRESENT IN THE STATE OF ILLINOIS WHEN THE TRANSACTION OCCURS.  This raffle is VOID OUTSIDE OF THE STATE OF ILLINOIS AND WHEREVER PROHIBITED BY LAW.  Participants must complete their purchase using the specified procedures in purchasing online.  All purchases are subject to verification, and no sale is final until the purchase is accepted by SCC.

 

ELIGIBILITY TO PARTICIPATE

Raffles may only be purchased by persons 18 years of age or older and live in the state of Illinois. in accordance with the official rules.  No discount or complimentary raffles are given.  Raffles will be available for purchase online only by eligible persons.

 

DRAWING

For each item, there will be 25 entries for the raffle unless otherwise indicated prior to accepting the raffle request.  At the time of the request, entrants will be given a position assignment based on the timing of their request of the remaining open positions (25 maximum per item); each position corresponds to a single number of 1 through 25.  Only 2 entries per person per item is acceptable; any more than that will be deemed void immediately.

Items will be delivered to the winners unless otherwise indicated prior to the posting of the item up for raffle.  Correspondence for coordination of the delivery of items will be through the email address of winthegold@sochicago.org. Unless otherwise indicated, the odds are 1 of 25 will win the item.  Special Olympics Chicago/Special Children’s Charities will make all reasonable efforts to contact the winners, and winners will also be posted on the Facebook group page at the end of the drawing.  Winners must claim the prize within seven (7) days of the announcement, or the item will be forfeited.   There are no cash prizes. If applicable, the prize winner will be issued an IRS Form 1099 or IRS Form W2-G for the amount of the prize.

After the posting of several items, a date and time will be presented for the actual drawings for the winning bids, which will occur online.  The date and time will be announced at least 24 hours before the actual drawing; once enough items have been presented.

All net proceeds will benefit Special Olympics Chicago-Special Children’s Charities.

By participating in the “Win the Gold” raffle, entrants grant permission to Special Olympics Chicago/Special Children’s Charities to use their name for the posting of the winners for the purpose of communicating and advertising for the activities of Special Olympics Chicago-Special Children’s Charities and in appealing for funds to support each activity.

Special Olympics Chicago-Special Children’s Charities shall use the following rules to determine the identity of the winner of any raffle:  the owner of the winning raffle shall be the individual whose information was used in paying for the raffle item.  Either Paypal or Zelle (preferred) will be the only method of payment.  There will be no credit card transactions.

By entering this raffle, each entrant agrees to abide and be bound to these official rules and to release, indemnify and hold harmless Special Olympics Chicago-Special Children’s Charities; it’s representatives, employees, Board of Directors, and affiliates from and against any and all liability claims, losses, damages, or causes of action of any kind (however named or described) with respect to rising out of the entrants’ participation in the raffle or winning any prize or the entrant’s acceptance, possession, misuse of use of any prize or participation in the raffle or any raffle related activity.  In addition, each winner agrees to release, indemnify, and hold the released parties harmless from any and all losses, damages, rights, claims, and actions of any kind arising in connection with or as a result of participating in the raffle or the winner’s acceptance or use of any winning prize.

 

LIMITATION OF LIABILITY

A raffle entrant’s sole and exclusive remedy for any released party’s breach of duty or conduct related to the raffle shall be limited to the return of the purchase price paid of their raffle ticket.  In no event shall any released party be liable to any person for any loss or injuries to earnings, profits, or goodwill, or for any incidental, special, or punitive consequential damages of any person or entity whether arising in contract, tort or otherwise, arising out of the raffle.

 

PUBLICITY RELEASE

Each official winner, by accepting their prize, grants Special Olympics Chicago/Special Children’s Charities designees and affiliates, full permission, except where legally prohibited, to use that official winner’s first and last name, city and state, photograph, statements, voice and/or other likeness and prize information for advertising, trade, and promotional purposes without further compensation, and without notice, approval or review in all media now known and hereafter discovered worldwide, and on the internet or worldwide web in perpetuity.

 

TRADEMARKS

All trademarks are the property of their respective owners and may not be used except with the express written consent of the trademark owners.

 

DISPUTES

Each raffle participant agrees that: (a) any and all disputes, claims and causes of action arising out of or in connection with this raffle, or any prize awarded, shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in the city of Chicago, Illinois, and each raffle participant submits to sole and sole and exclusive personal jurisdiction of said courts in the State of Illinois for any such dispute and irrevocable waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred to purchase the raffle ticket, but in no event attorneys’ fees; and (c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for the actual out-of-pocket costs to purchase the raffle tickets, and entrant waives any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation, and enforceability of these official rules, or the rights and obligation of participants or Special Olympics Chicago-Special Children’s Charities in connection with the raffle shall be governed by and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict law rules of provisions (whether the State of Illinois, the United States. or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of Illinois.  If a court of competent jurisdiction finds that any provision of these official rules, or their application to particular persons or circumstances, is invalid or unenforceable to any extent, then the remainder of these official rules, and the application of all of these official rules to other persons or circumstances, shall not be affected by that determination and shall remain enforceable to the fullest extent permitted by law.
